FEES & REPRESENTATION

What to ask about fees before you retain a lawyer.

Understand scope, flat fee options, additional costs and payment arrangements before deciding how to proceed.

19 OCTOBER 2026 · EDITORIAL DRAFT · 3 min read

Begin with the scope of the work.

A meaningful fee conversation starts with the services being proposed. Ask what stages or tasks are included and whether any work is outside that scope. The answer may depend on the charge, the information available and how the matter develops.

A free initial consultation does not mean that every service is free. Confirm what the initial conversation includes, what further work is being proposed and what must be agreed before representation begins.

Ask how the total is described.

If a flat fee is offered, ask what it covers and how taxes and disbursements are treated. Clarify whether additional appearances, travel or other work could require a separate agreement. “No hidden fees” should translate into a clear discussion of those arrangements, not an assumption that every possible cost is included.

Request the proposed arrangements in writing so you can review them and raise questions. A simple summary of the services, exclusions and payment timing can make later conversations easier.

Discuss the payment schedule.

If you need a payment plan, ask which arrangements are available for your matter and when payments would be due. Availability should be confirmed with the office; a website description is not an approval of a particular payment arrangement.

Before moving forward, make sure you know whom to contact about billing questions and how changes to the proposed work will be discussed. The aim is clarity about what you are agreeing to, as well as clarity about the legal assistance you are seeking.

This is a general preparation guide and an editorial draft, not legal advice. It has not been presented as an approved lawyer-authored publication. Obtain advice about your own situation and confirm all arrangements with the office.
